A man accused of raping a seven-year-old girl at a restaurant in Pretoria is expected back in court on Tuesday.
Nicholas Ninow appeared in the high court in Pretoria on Monday and pleaded guilty to rape, possession of drugs and defeating the ends of justice.
Ninow is accused of raping a seven-year-old girl in the bathroom at a Dros restaurant last year.
Ninow's lawyer read out his client's plea, detailing what happened.
"I realised at the time that my actions were unlawful and that I was committing an offence."
The state, however, rejected his plea explanation.
Despite Ninow pleading guilty, the state will continue with the trial with disagreement over his plea argument.
The state called its first witness, a waitress at the restaurant. The witness told the court how she found Ninow inside a female cubicle.
The waitress, who cannot be named, said that the girl's mother came into the female toilet and shouted her daughter's name but there was no answer.
A few minutes later, the mother returned with the restaurant's childminder who then forced open the cubicle door.
On Tuesday, the state is expected to call more witnesses after rejecting Ninow's plea explanation.
Prosecutor Dora Ngobeni said that the plea explanation does not "sketch out directly how the incident occurred, and as such, the state will continue with the trial".
